The Virginia Senate is set to take a final vote on Monday, March 5, on a bill, which  would be extremely detrimental to how organizations, including long term care providers, can defend themselves in liability cases.

About HB 1336
HB 1336 would overturn a unanimous Virginia Supreme Court decision issued in late 2017 (Emerald Point, LLC v. Hawkins, 2017 Va. Lexis 197) by allowing a judge to instruct a jury that if records are altered or destroyed (intentionally or not), then the jury can infer those destroyed or altered records indicate liability on the defendant’s part.
