Information on Department of Health Professions Waivers

During the COVID-19 public health threat, the Virginia Department of Health Professions (DHP) has established temporary waivers to various regulations during the declared state of emergency. The waivers cover reinstatement or reactivation of licensure and issues affecting RNs, LPNs, medication aides, and related education programs. Executive Orders from Gov. Ralph Northam also address out-of-state licensees working in nursing facilities.

Hancock Daniel has prepared an updated summary of the waivers. You can also review each waiver the full letter for each temporary waiver, please see the links below:

Out-of-State Licensees

In response to Gov. Ralph Northam’s Executive Orders 42 and 51, hospitals, licensed nursing facilities, and dialysis centers providers in Virginia can write a letter to DHP on their letterhead prior to or within a reasonable time after employing or engaging an out-of-state licensed provider. Provide DHP the following information:

  • Name of the licensed provider
  • State of licensure
  • License type
  • License number

We also recommend providers make sure any additional licensees are covered under a professional liability policy or added to the facility’s policy.
