DSS Issues Memo on 2025 Legislation

What’s new: DSS sent a memo to all licensed assisted living facilities on May 19 with information about legislation passed during the 2025 General Assembly session that affects them.

  • The memo focuses on two pieces of legislation: one related to receivership and the second related to provisional licenses.

 

SB 1153: This legislation amends the Code of Virginia to specify the circumstances under which the Commissioner of Social Services may petition the court to appoint a receiver for an assisted living facility and describes the procedures to be followed for the filing of such petition and when the receivership has been established.

  • DSS will update the regulation, 22VAC40-80, General Procedures and Information for Licensure, to reflect this legislative change.
  • This legislation became effective on April 2, 2025.

 

SB 937 and HB 2597: This legislation amends the Code of Virgina to require corrective action which is acceptable to and on a schedule determined by the Commissioner of Social Services prior to an appeal of a provisional license issued to an assisted living facility or adult day center.

  • DSS will update the regulation, 22VAC40-80, General Procedures and Information for Licensure, to reflect this legislative change.
  • This legislation is effective on July 1, 2025
