Update on Department of Labor Proposed Rules

The Department of Labor has recently published three notices of proposed rulemaking that may affect nursing centers and assisted living communities related to overtime and joint employer arrangements. DOL is accepting public comments on the notices.

  1. Overtime Threshold (Comments due May 21): proposes several changes related to overtime, including raising the overtime threshold for exempt employees. For more information on this notice, refer to this article: DOL Proposes Update to Overtime Pay Rules.
  1. Regular Rate Requirements (Comments due May 28): proposes to define what forms of payment employers include and exclude in the “time and one-half” calculation when determining workers’ overtime rates.
  1. Joint Employer Status (Comment date not announced but likely early June): proposes to revise and clarify the responsibilities of employers and joint employers to employees in joint employer arrangements.
