Resources to Help You Respond to CNN Report on Abuse

Resources page photo_0This week CNN issued a lengthy report detailing cases of sexual assaults in long term care facilities.  While none of the incidents mentioned in the investigative report occurred in Virginia, CNN did look at inspection reports in every state and found evidence that more than 1,000 facilities were cited “for mishandling or failing to prevent alleged cases of rape, sexual assault and sexual abuse at their facilities” between 2013 and 2016.  VHCA-VCAL, along with AHCA/NCAL, are appalled and troubled by these reports.   Any person who commits these heinous acts should be penalized to the fullest extent of the law.  AHCA/NCAL has developed resources and talking points you can use if families have questions about the report and to provide reassurance about the steps you are taking at your center to prevent abuse or report any allegations.

As a reminder, the new requirements of participation rules require that in response to allegations of abuse, facilities must report immediately, but not later than 2 hours after the allegation is made, to officials including the State Survey Agency and law enforcement authorities.  For more details on the reporting requirements and related investigative obligations, see 42 CFR 483.12.

Health care providers also have a duty to check the List of Excluded Individuals and Entities (LEIE) database file to ensure excluded individuals are not working in their facilities.  The updated files are posted on the Department of Health and Human Services Office of Inspector General website. Instructional videos explaining how to use the online database and the downloadable files are also available online.  Long term care providers should check the LEIE, which is updated monthly, on a regular basis.
