What’s happening: DSS has notified assisted living facilities (ALFs) via a March 5 memo that that agency will be verifying that facilities are maintaining their required liability insurance coverage under § 63.2-1805 and 22VAC40-73-45.

• DSS will be issuing a survey so ALFs can verify that they are carrying the minimum coverage.

What to look for: The request to complete the survey will be sent from the email address shelly.elliott@dss.virginia.gov.

• Inspectors will review specific verification of the facility’s liability insurance coverage during the next mandated or renewal inspection at the facility.

As a reminder, as of January 23, 2025, ALFs shall maintain liability insurance based on licensed capacity tiers pursuant to § 63.2-1805:

• Tier I requires a minimum of $250,000 for facilities licensed for 25 residents or less.
• Tier II requires a minimum of $400,000 for facilities licensed for 26-75 residents.
• Tier III requires a minimum of $500,000 for facilities licensed for 76-150 residents.
• Tier IV requires a minimum of $1,000,000 for facilities licensed for 151 or more residents.
