CMS S&C Memo: Protecting Residents from Abuse via Photography/Video

Protecting resident privacy and prohibiting mental abuse related to photographing or recording residents in any manner that would demean or humiliate them is the subject of a new S&C memo from CMS.

In the memorandum, S&C: 16-33-NH, Protecting Resident Privacy and Prohibiting Mental Abuse Related to Photographs and Audio/Visual Recordings by Nursing Home Staff, sent to state survey agency directors issued on August 5, the Centers for Medicare and Medicaid Services (CMS) has announced at the time of the next standard survey for both the traditional survey and the Quality Indicator Survey (QIS), the survey team will request and review your center’s policies and procedures that prohibit staff from taking, keeping and/or distributing photographs and recordings that demean or humiliate residents.  This includes any type of equipment (e.g., cameras, smart phones, and other electronic devices) to take, keep, or distribute photographs and recordings on social media.

The memo directs survey teams to begin the review of such policies for standard survey immediately.
