Are you ready? As of January 23, 2025, Virginia assisted living facilities (ALFs) must comply with new liability insurance coverage requirements and use the DSS-provided Liability Insurance Statement and revised Disclosure Statement forms.

• ALFs can begin using the new forms earlier if they meet the coverage requirements based on their licensed capacity.
• This November 13 DSS memo outlines the insurance requirements and contains the current forms (including a correction to a previously posted version of the Disclosure Statement.)

Under the revised regulations, ALFs shall maintain liability insurance based on licensed capacity tiers pursuant to § 63.2-1805:

• Tier I requires a minimum of $250,000 for facilities licensed for 25 residents or less.
• Tier II requires a minimum of $400,000 for facilities licensed for 26-75 residents.
• Tier III requires a minimum of $500,000 for facilities licensed for 76-150 residents.
• Tier IV requires a minimum of $1,000,000 for facilities licensed for 151 or more residents.

Why the change: Legislation passed in 2023 directed DSS to issue updated regulations.
