VHCA Associate member Mellette PC has prepared a client advisory on “The Duty to Accommodate: Increasing Penalties and Sanctions for Providers Who Fail to Furnish Civil Rights Accommodations”.
Government agencies, including the U.S. Departments of Justice and Health and Human Services, are cracking down on hospitals, physicians, and rehabilitative service providers for their failure to provide accommodations and access to individuals protected under federal disability and civil rights laws. Settlements have included a range of disciplinary action from government oversight of operations to fines and defunding. Providers should review their policies and practices related to accommodating disabled individuals and providing access to healthcare services, especially for those with communication barriers.
